Service Descriptions:  Mobile Coverage Service by InfiniG (the “Service”) is an annual subscription consisting of (a) Secure connections to one or more participating Mobile Network Operators (MNOs) over an in-building cellular radio network, thus enabling subscribers of those MNOs to receive mobile service within the coverage area of such network; and (b) On-going operation, monitoring and management of such secure connections during a paid and active subscription term.  On-Boarding is a one-time fee consisting of validation of radio coverage, testing and certification of 911 and RF safety regulations, and activation for all participating MNOs available at the time of testing.

Terms of Use:  The quality and performance of the Service relies on the availability of the local network and Internet connections.  In order to maintain such quality and performance, End-Customer must (a) Maintain an Internet connection as required to meet the needs of the Service; (b) Avoid making changes to the local network (LAN) infrastructure, firewalls or other network components that could impact the cellular radio network’s ability to connect to the Service; (c) Provide InfiniG or its assignee access rights to monitor the network programmatically through API connections; and (d) Grant InfiniG or its assignee the right to update or upgrade the Service for regular maintenance, quality, performance, security or make other changes to the Service.  In addition, End-Customer shall not (a) provide unauthorized application services, rental, outsourcing, or time sharing in connection with, any license rights to embedded software granted through the purchase of the Equipment; (b) make error corrections to or otherwise modify or adapt any embedded software or create derivative works based upon such software, or permit third parties to do the same; (c) decompile, decrypt, reverse engineer, disassemble or otherwise reduce the embedded software to human-readable form to gain access to the embedded software or any trade secrets or confidential information contained therein; or (d) copy the embedded software, except for archival or backup purposes or as required by normal installation procedures.

Regulatory Restrictions:  The Service by nature carries traffic on behalf of Mobile Network Operators, who are in turn bound to US FCC regulations regarding the safety and well-being of the general public, such as delivering 911 calls and public service announcements. In order to comply with these regulations, certain network parameters, including the physical coordinates of the radios, are captured and memorialized in a document called the Customer Information Questionnaire (CIQ) and validated by InfiniG before turning on the Service.  Once the CIQ is validated, End-Customer or its assignees agree not to change, or enable others to change, such configuration parameters without InfiniG’s prior written approval. Such changes without InfiniG approval and re-validation may result in FCC fines and/or other penalties.
